1. Introduction and Acceptance
These Terms of Use ("Terms") constitute a legally binding agreement between you ("Guest," "you," or "your") and Mission Villa JA ("Mission Villa JA," "we," "us," or "our"), a business operating in Jamaica.
By making a booking, using our website, or staying at Mission Villa JA, you agree to these Terms. If you do not agree, you may not use our services.
These Terms are governed by the laws of Jamaica. Any disputes will be resolved in the courts of Jamaica.
2. Booking and Reservations
2.1 Booking Process
- All bookings must be made through our website, email, or phone
- Bookings are confirmed only upon receipt of a 50% down payment
- You must be at least 21 years old to make a booking
- All information provided during booking must be accurate and complete
2.2 Payment Terms
- Deposit: 50% down payment due at time of booking
- Balance Payment: Full payment required before arrival
- Accepted Payment Methods: All major credit cards, debit cards, and bank transfers
- Currency: All prices are quoted in USD
- Payment Processor: Payments are processed securely through our third-party payment processor
2.3 Security/Damage Deposit
A refundable security deposit of $250 is required upon check-in. The deposit will be returned within 7 days after checkout, subject to inspection for damages.
3. Cancellation and Refund Policy
3.1 Guest Cancellations
- 31+ days before arrival: Full refund (100%)
- 15-30 days before arrival: 50% refund
- 14 days or less before arrival: No refund
- No-shows: All payments are forfeited, no refund
3.2 Changes to Bookings
Changes to dates are subject to availability. Changes requested within 30 days of arrival are not permitted. Please contact us as early as possible if you need to modify your reservation.
3.3 Force Majeure and Cancellations by Mission Villa JA
- We reserve the right to cancel bookings due to circumstances beyond our control (natural disasters, government restrictions, property damage, etc.)
- In the event of cancellation by us, you will receive a full refund or credit toward a future stay
- We are not liable for costs incurred due to cancellation (flights, travel arrangements, etc.)
3.4 Refund Processing
Approved refunds will be processed within 14 business days to the original payment method.
4. Check-In and Check-Out
- Check-In Time: 3:00 PM
- Check-Out Time: 11:00 AM
- Early Check-In/Late Check-Out: Available by request based on availability. Additional fees may apply.
- Valid photo identification is required at check-in
4.1 Property Accessibility
Property requires using stairs throughout. Not suitable for guests with limited mobility or those unable to navigate stairs. Mission Villa does not have an elevator or lift.
5. Occupancy and Guest Limits
- Maximum Occupancy: 12 guests for the entire villa
- Exceeding maximum occupancy is strictly prohibited and may result in immediate eviction without refund
- All guests must be registered at check-in
- Overnight visitors are not permitted without prior approval
- Age Restriction: No guests under 21 years of age are permitted
6. House Rules
Guests must comply with the following house rules:
- Smoking: Smoking is not allowed anywhere on the property. Violation will result in a $1,000 fine
- Pets: Pets are not permitted on the property
- Parties/Events: Parties and events are not permitted without prior approval
- Pool Use: Pool safety rules must be followed. Children must be supervised at all times
- Outside Guests: Outside guests are not allowed on the property without prior approval
- Respect neighboring properties and keep noise to a reasonable level
- No illegal activities or substances on the property
- No removal of property items (towels, amenities, furniture, etc.)
7. Guest Responsibilities
As a guest, you agree to:
- Treat the property and furnishings with care and respect
- Report any damages, malfunctions, or issues immediately to management
- Leave the property in the same condition as upon arrival (normal wear and tear excepted)
- Be financially responsible for any damage caused by you or your guests
- Follow all safety instructions and emergency procedures
- Comply with all Jamaican laws and local regulations
8. Damage and Liability
8.1 Guest Liability for Damage
- You are responsible for any damage to the property caused by you or your guests
- Repair/replacement costs will be deducted from your security deposit
- We reserve the right to charge your payment method for damages that exceed the security deposit amount
8.2 Our Liability Limitations
Mission Villa JA is not liable for:
- Loss, theft, or damage to personal belongings
- Personal injury or accidents on the property (except where caused by our proven negligence)
- Service interruptions (water, electricity, internet) beyond our control
- Weather conditions or natural events affecting your stay
- Acts or omissions of third-party service providers (tour operators, private chefs, transportation)
We recommend purchasing comprehensive travel insurance covering trip cancellation, medical emergencies, and personal property.
9. Services and Amenities
- Housekeeping: Daily light housekeeping is included. Full linen changes occur every 4th day during your stay. Additional cleaning services available upon request for an extra fee.
- Private Chef: Available upon request for an additional fee. Must be arranged in advance.
- Transportation: Airport transfers and local transportation can be arranged upon request for an additional fee.
- Wi-Fi: Complimentary high-speed internet is provided. We are not responsible for service interruptions.
10. Retreat-Specific Terms
For retreat bookings:
- Retreat bookings may require a minimum number of participants
- Final headcount must be confirmed at least 30 days before arrival
- Retreat packages include accommodation and specified amenities as agreed in the booking confirmation
- Custom retreat arrangements will be detailed in your booking confirmation
11. Privacy and Personal Information
Your personal information is handled in accordance with our Privacy Policy. By using our services, you consent to our collection and use of your information as described.
12. Website Use and Intellectual Property
- All content on our website (text, images, logos, design) is owned by Mission Villa JA or licensed to us
- You may not reproduce, distribute, or use our content without written permission
- Our website is provided "as is" without warranties of any kind
13. Right to Refuse Service
We reserve the right to refuse service or terminate a booking if:
- You violate these Terms or house rules
- You engage in illegal, dangerous, or disruptive behavior
- You provided false or misleading information during booking
- Your behavior threatens the safety or comfort of others
In such cases, no refund will be provided, and you will be required to leave the property immediately.
14. Indemnification
You agree to indemnify and hold harmless Mission Villa JA, its owners, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the property, violation of these Terms, or violation of any laws.
15. Dispute Resolution and Governing Law
- These Terms are governed by the laws of Jamaica
- Any disputes will be resolved in the courts of Montego Bay, Jamaica
- We encourage guests to contact us directly to resolve any issues before pursuing legal action
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
17. Changes to Terms
We may update these Terms from time to time. Changes will be posted on our website with a new "Last Updated" date. Your continued use of our services after changes constitutes acceptance of the updated Terms.
